Rivica Surveillance Service Agreement

This agreement outlines the terms and conditions for the supply of investigative services by RIVICA Investigations & Covert Solutions Pty Ltd as agreed upon with you, hereinafter referred to as ‘the client’

RIVICA Investigations & Covert Solutions Pty Ltd reserve the right to change or alter any agreed services without notice, where it is believed the changes are necessary to prevent compromising the investigation or for the safety of our staff.

Surveillance Fees

Flat Rate for Locations Within 25 km of Melbourne CBD

Surveillance fees start at a flat rate of $675 (plus GST) for each surveillance deployment. This fee includes four (4) consecutive hours of surveillance within a 25 km radius of the Melbourne CBD GPO.

Surveillance hours exceeding the initial four (4) hours included in the flat rate will be charged at $100 per hour (plus GST), or part thereof.

Inclusive time starts from the time surveillance is commenced and finishes at the time surveillance is ceased.

Unplanned Expenses

All reasonable ‘Unplanned Expenses’ such as reconnaissance, administration, travel kilometres, surveillance kilometres (capped at 100 kms), tolls, parking, report preparation, and processing of video/images are included in the flat rate but capped at a total of $100.

Expenses exceeding the capped total will be invoiced to the client.

Kilometres travelled during surveillance above the 100 km cap will be charged at $0.85 per kilometre.

Planned Expenses

Any ‘Planned Expenses’ (e.g., theatre tickets, restaurant attendance, hotel accommodation, city parking, or event entry fees) required during surveillance will be invoiced to the client.

Hourly Rate for Locations Beyond 25 km of Melbourne CBD

For surveillance commencing outside the 25 km radius of the Melbourne CBD, the hourly rate will be $110 per hour (plus GST).

Travel to and from the surveillance location will be charged at $1.00 per kilometre, starting from RIVICA’s office in South Melbourne.

An estimate of 100 surveillance kilometres will be included in each deployment. Any unused portion of the estimated kilometres will be refunded upon completion of the surveillance.

Discounts for Multi-Day Surveillance

The following hourly discounts apply for clients booking multiple surveillance deployments in advance:

– 5% hourly discount for three (3) or more deployments.

– 7.5% hourly discount for six (6) or more deployments.

– 10% hourly discount for nine (9) or more deployments.

For surveillance requests qualifying for these discounts:

A retaining fee of 50% of the total quoted services is payable by the client upon accepting these conditions to secure our services.

The balance of the quoted services must be paid and received 24 hours prior to the commencement of the surveillance investigation.

If the balance is not received 24 hours prior, the investigation will not commence until 24 hours have elapsed after payment has been received.

Public Holiday Surcharge

Surveillance conducted at the client’s request on a public holiday will incur a surcharge of 100% of the agreed rate. A list of quoted items will be provided before work commences.

Additional Agents

In some circumstances, additional agents may be required to achieve the surveillance objectives.

Fees for additional agents will be 70% of the daily flat rate and hourly rate for each additional agent required. These costs will be discussed and agreed upon with the client prior to commencing the surveillance.

Payment Terms

Standard Surveillance Payments

Payment for requested surveillance must be paid in full and received by RIVICA at least 24 hours prior to the assignment commencement time.

For surveillance requested within 24 hours of the required commencement time, a $150 (plus GST) urgent/late booking fee will be applied.

Booking Procedure

Once a time and date is requested by the client and agreed by RIVICA, the booking will be held for 24 hours.

An invoice will be sent to the client, and if payment is not received within 24 hours, the allocated period will be made available to other clients.

Refunds for Unused Kilometres

For surveillance beyond the 25 km radius, an estimate of 100 surveillance kilometres will be included in each deployment. Any unused portion of this estimate will be refunded upon completion.

Weekly Invoicing and Late Fees

RIVICA will invoice the client for additional hours worked and any additional expenses on a weekly basis. Unless otherwise agreed, all invoices must be paid in full within seven (7) days of receiving the invoice.

A late fee of 5% of the total invoice amount will be added to the balance outstanding at the end of every calendar month, along with any additional third-party collection agency costs if required.

Court Fees

If RIVICA staff are required to attend court on behalf of a client’s investigation, a flat rate fee of $1500 (plus GST) per operative per day will apply for attendance or to remain on standby.

Courtroom appearance fees must be paid seven (7) days in advance of the court date.

If court appearances are cancelled within 48 hours of the scheduled appearance, the full scheduled fee will still be payable.

Cancellation

If the client cancels work within 24 hours of the requested commencement time and date, the client will be refunded the amount paid minus a $275 plus GST cancellation fee.

Interference

The client agrees that neither they nor any friend, relative, colleague, employee, or agent will interfere with the investigation process. Clients also agree not to attend or visit in or around a location under surveillance by RIVICA agents.

Accuracy of Information

The client understands that the accuracy of data is not guaranteed. RIVICA will exercise every care and effort to ensure data is relevant and accurate. The full fee schedule is still payable if the investigator has made best efforts to provide accurate data.

Use of Information

The client agrees that they will not use any information provided by RIVICA to commit, or allow to be committed, any crime or wilfully bring harm to any persons or companies through negligence or malice.

The client also agrees that no legal orders will be breached by engaging RIVICA’s services.

Confidentiality

The client agrees to keep all information provided by RIVICA confidential and only disclose it to parties with a legitimate and lawful requirement to know.

Law

All applicable laws in the areas where work is performed will govern the services provided by RIVICA. RIVICA reserves the right to refuse any part of a job if it believes any laws will be breached.

Data Storage

All client data will be stored on encrypted storage until it is presented to the client or in a courtroom. After this, all data will be deleted.

Reports, photographs, and video footage will be uploaded to a secure folder within RIVICA’s Dropbox. The client will be provided with a link to access and download the evidence obtained at the end of each surveillance deployment.

Observations recorded during surveillance will comply with State evidentiary rules and legislative requirements and will be retained for potential use in future court proceedings.

Video footage and images will also comply with evidentiary rules to maintain the integrity and continuity of evidence.

RIVICA provides no warranties or guarantees regarding the information provided. Any compensation for loss or harm caused by RIVICA’s services is limited to the cost of the service provided.

The risk of losing a subject during surveillance is influenced by factors such as time of day, traffic conditions, and the subject’s awareness. Fees are not contingent on the outcome but solely for the attempt to collect information.

Information gathered may not always be favourable to the client. All information will be presented impartially, even if it is not favourable.
